But to become a Legal Heirs, you need a certificate. Only after that all types of assets are transferred to you.
How to Make a Legal Heir Certificate?
To make Legal Heir Certificate or Surviving Member Certificate, you have to apply in the district magistrate’s office or district court.
To Make a Surviving Member Certificate, you need the following documents along with filling the Application Form available in the Magistrate Office / Court –
- Copy of Identity Proof Such as PAN Card, Aadhaar Card
- Copy of Address Proof
- Original Death Certificate of that Deceased Person
- Copy of Identity Proof & Address Proof of Deceased Person
- Affidavit Of Undertaking By The Applicant
First of all, all the physical documents along with the application form are submitted by the District Court / District Magistrate Office, after a few days your address is visited by the official for the verification process.
After that you will need two neighbors as witnesses. A copy of their Identity Proof and Address Proof can be sought by the official. You may be asked for documents by the official. However, you will already have all your documents from them.
After the completion of the address verification, your Legal Heir Certificate will be ready within about one to one and a half months, which you can get from the District Magistrate Office.
How to Download Legal Heir Certificate?
When your certificate is ready, after that you are notified through email or SMS. You can get the surviving member certificate from where you submitted all your applications and documents. Apart from this, you can also download the certificate through the online portal.
